1.1. LANOUVE GmbH (referred to hereafter “LANOUVE” or “we”), operates an online shop under the internet address www.lanouve.com (referred to as “Website”).
The following general terms and conditions (GTCs) in their currently valid edition apply exclusively for all orders that consumers (§ 1 KSchG) make for our goods and services over the website.
1.2. Consumers are consumers in the sense of the Consumer Protection Act (KSchG) and thus natural and legal persons who are not business persons. A business person is anyone for whom the transaction is part of operations at his/her business. A business is any permanently established organisation of independent commercial activity whether or not it aims to make a profit. Legal persons under public law are always deemed business persons.
2. Contracting Partners
The purchase contract will be with LANOUVE GmbH, Theresiengasse 17/5, 1180 Vienna, court of commercial registration Vienna, FN361919.
3. Range of Products and Conclusion of Contract
3.1. The presentation of products in the online-shop does not constitute a legally binding offer, but instead an opportunity to order our products. Mistakes are reserved.
3.2. By clicking on the order button, you are submitting a binding order for the goods listed on the order sheet. After your order is received, we will send you an e-mail that confirms the receipt of your order and the details of your order (order confirmation).
3.3. The purchase contract between the ordering party and LANOUVE only takes effect once the good is dispatched form the LANOUVE warehouse. The ordering party will be sent a shipping confirmation by e-mail at this time. LANOUVE is entitled to reject an offer without stating its reason.
4. Instruction on Revocation
Below you will find the legally mandated instruction concerning the preconditions and consequences of the right of withdrawal.
You have the right to revoke this contract within fourteen days without stating any reasons. The revocation period is fourteen days from the day on which you or a third party you designate who is not the freight carrier took or had taken possession of the last good.
To exercise your right to withdraw you must inform LANOUVE GmbH (Theresiengasse 17/5, 1180 Vienna, firstname.lastname@example.org) with a clear, unequivocal declaration (e.g. a letter sent by post or an e-mail) of your decision to revoke this contract. You can use the enclosed sample withdrawal form but this is not required.
For meeting the deadline to exercise the right of withdrawal it is sufficient that the communication concerning the exercise of the right of withdrawal is sent out before the expiration of the revocation period.
Effects of revocation
If you revoke this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. Send returned goods to LANOUVE GmbH, Theresiengasse 17/5, 1180 Vienna.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to examine the nature, characteristics and functioning of the goods.
5. Return Shipment
5.1. All articles that you purchased via lanouve.com can be sent back within 14 days of receipt of the goods.
5.2. We will assume the costs for return shipment as long as the following guidelines are met:
- The return of goods is done only using the carriage company that delivered the goods.
- Please send us an e-mail (email@example.com) with a request for the return sticker.
- Please note that we can only accept return shipments from the country to which the order was delivered.
- In the event of a return shipment, a credit will be posted to your account/your card; any losses caused by variations in currency exchange rates will not be compensated.
- We ask you to consider the following points in case of a return shipment:
- The articles should be in their original condition and returned in their original packaging.
- The good should be unworn and in perfect condition.
- The labels and certificates may not have been removed.
6. Legal warranties
The provisions on the statutory warranty apply. The warranty period for the delivery of goods is 2 years from the date of receipt of the goods. Complaints due to legal warranty claims can be made under the contact details stated in the imprint. We do not provide any guarantees in addition to the statutory warranty.
7. Prices and Shipping Costs
7.1. The prices named on the product pages are gross sales prices and include the legally mandated VAT and other elements of the price.
7.2. In addition to the stated product prices, shipping costs will be added. You can find out more about shipping costs in the offers.
8. Delivery and Transfer of Risk
8.1. Depending on the place of delivery, the delivery will be executed with the transport company offering the best price, e.g. UPS or DHL.
8.2. Depending on the destination, the delivery will take up to seven working days. We will make note of any possible differing delivery times on the specific product page.
8.3. The risk of incidental loss and incidental worsening in the quality of goods transfers to the customer as soon as the good is handed over to the customer.
8.4. The risk stated in point 8.3. transfers to the customer with hand-over of the good to the shipping company, the freight carriers or other person or institution otherwise designated to transport the goods to the customer, if the customer himself concluded a shipping contract with a different shipper, without having made use of a selection option suggested by LANOUVE.
8.5. If the customer defaults in accepting the goods, the risk of loss or incidental worsening in quality of the good transfers at the point when the customer enters default of acceptance.
9.1. In our online shop, the following modes of payment are available: Visa and MasterCard, American Express, Diners Club, JCB, Maestro International DebitCard, electronic bank transfer, eps – electronic payment standard.
9.2. When selecting the credit card mode of payment, your credit card will be charged with ordering or shipment of the goods.
10. Reservation of Title
The goods remain our property until full payment.
11. Concluding Provisions
11.1. Austrian law applies to this contract exclusively. Place of jurisdiction is Vienna.
11.2. Should individual provisions of this contract with the customer including these general terms and conditions prove wholly or partly void or become so, the validity of the remaining provisions will not be compromised. The provision that is wholly or partly void will be replaced by a provision that most closely approximates the intended commercial purpose of the void provision.
